The first six essays deal with the application and administration of the canon law. England in the medieval period existed under two laws - the law of the state and the law of the church. The law of the state was made up of customary law (of indigenous, native growth), of feudal law and of common (or royal) law. The english common law, dependent on original writs, was in its infancy in the twelfth century. Later it cross-pollinated church law in some areas but its real force was as a land law. The law of the church (or canon law) applied to every Christian country in Western Europe. Canon law covered al cases of marriage (seperation), legitimacy, wills, church property and tithes, and defamation. In England these main areas of jurisdiction remained with the ecclesiastical courts until 1857. The Roman or civil war, the other root law of most of Europe, had no hold in England as a legal system (as it did in the Mediterranean countries and in Scotland), but its procedure was adapted to the needs of the developing canon law courts and in this way it exerted an important influence. The articles in this volume, as in all others in the Collected Studies Series, have not been given a new, continuous pagination. In order to avoid confusion, and to facilitate their use where these same studies have been referred to elsewhere, the original pagination has been maintained wherever possible. Each article has been given a Roman number in order of appearence, as listed in the contents. This number is repeated on each page and quoted in the index entries.
