By Act of Congress, approved March 26, 1804, the territory purchased from France was divided into two Territories, Louisiana and Orleans, the latter, with the exception of the country between the Mississippi and Pearl Rivers and north of Lakes Pontchartrain and Maurepas, being co-terminous with the present State of Louisiana. The temporary government of the Territory of Orleans established by this act, provided for the appointment by the President of the United States, of a Governor, a Secretary and a Legislative Council of thirteen. The judicial power was vested in a Superior Court, and in such inferior courts and, justices of the peace, as the legislature of the Territory may from time to time establish. The Superior Court consisted of three judges and had jurisdiction in all criminal cases, which jurisdiction was exclusive in all capital cases; in civil matters they had original and appellate jurisdiction in all cases of the value of one hundred dollars. A United States District Court was also established. The act continued in force the laws of the Territory not inconsistent with its provisions. The importation of slaves was forbidden. Except in the cases of those who were actual bona fide settlers prior to December 20, 1803, all grants of crown lands, made subsequent to the treaty of St. Ildefonso, (October 1, 1800)were declared null, void and of no effect.
